ANSWERING YOUR CIVIL PARTNERSHIP DISSOLUTION QUESTIONS

HOW DO YOU END A CIVIL PARTNERSHIP?

The process of ending a civil partnership is the exact same as getting divorced. Both are governed by the Divorce, Dissolution and Separation Act 2020. You can choose to apply for dissolution together as a joint application where both parties will be referred to as joint applicants or a sole application where there will be an applicant and respondent, and this can either be done online.

HOW LONG DOES A CIVIL PARTNERSHIP DISSOLUTION TAKE?

At a minimum, a civil partnership dissolution takes 26 weeks to finalise, and this is from when the application was submitted to receiving the final order. Once the dissolution application is submitted, there will be what’s known as a cooling-off period which lasts for 20 weeks. After this time has passed, the Conditional Order can be applied for, there will then be a further 6 weeks and one day until the applicant or joint applicants can apply for the Final Order.

Despite this minimum 6 month time period to receive the final order, other aspects which are involved in dissolving your civil partnership can take considerably longer. If you are unable to agree on how finances will be divided or where children will live, you may need to go to court for a decision.

WHAT ARE THE GROUNDS FOR CIVIL PARTNERSHIP DISSOLUTION?

There is only one ground for civil partnership dissolution, and that is that the civil partnership “has broken down irretrievably”. Applicants will need to provide a statement claiming this during the application process.
