OUR CIVIL PARTNERSHIP DISSOLUTION SERVICES
APPLYING FOR A CIVIL PARTNERSHIP DISSOLUTION
The application to apply for a civil partnership dissolution has become easier since the recent change to the law, but it is important that the application form is correctly filled out. This can be done online.
To ensure everything is efficiently done and to prevent delays in the dissolution process, it’s wise to seek guidance from a solicitor who can assist you in completing the application form and ensuring everything necessary has been considered and added should it be required.
Should you need assistance applying for a civil partnership dissolution in Winchester, Sunningdale and Alresford our solicitors are here to help.
RESPONDING TO A CIVIL PARTNERSHIP DISSOLUTION
When a sole application for civil partnership dissolution is submitted to the court, a copy of the application will be sent to the respondent. They are required to respond to this within 14 days, acknowledging the application through an ‘acknowledgement of service form’.
Our civil partnership dissolution solicitors in Winchester, Sunningdale and Alresford can provide expert advice and assistance with the acknowledgement of service form, helping to ensure it is efficiently filled out so there are no future issues that could interrupt the dissolution process.
CIVIL PARTNERSHIP DISSOLUTION FINANCIAL SETTLEMENT
When you dissolve your civil partnership, one significant consideration which needs to be made is how your finances will be divided. This can undoubtedly cause disagreements between parties, especially in regard to more valuable assets such as property and pensions.
A financial settlement can be decided either between yourselves, or the court can make a legally binding decision. Either way, it’s important to ensure your decision has a financial order so no future claims can be made.
Our solicitors recognise the challenges with regard to finances and will point you in the right direction, often encouraging non-contentious approaches such as private negotiation. We can also assist with applying to court for a financial order to ensure no future claims are made.
If agreeing on a financial settlement is something you and your partner are unable to do, our civil partnership solicitors in Winchester, Sunningdale and Alresford can guide you through court proceedings where a judge will make a final legally binding judgement.
ARRANGEMENTS FOR CHILDREN
Civil partnership dissolution can feel even more challenging if you share children together because there never will be that clean break, especially when you need to juggle living arrangements and contact between yourselves.
Most parents will have a set view on where their children should reside following a dissolution, but it’s important to consider your children’s wishes and to maintain any parent and child relationship.
Our solicitors can help negotiate an arrangement that is suitable to you both while making certain the children’s best interests are met. In some instances, it may be more appropriate to obtain a child arrangement order from the court. Should this be necessary, our solicitors can support you by delivering a strong argument in your favour.
ANSWERING YOUR CIVIL PARTNERSHIP DISSOLUTION QUESTIONS
HOW DO YOU END A CIVIL PARTNERSHIP?
The process of ending a civil partnership is the exact same as getting divorced. Both are governed by the Divorce, Dissolution and Separation Act 2020. You can choose to apply for dissolution together as a joint application where both parties will be referred to as joint applicants or a sole application where there will be an applicant and respondent, and this can either be done online.
HOW LONG DOES A CIVIL PARTNERSHIP DISSOLUTION TAKE?
At a minimum, a civil partnership dissolution takes 26 weeks to finalise, and this is from when the application was submitted to receiving the final order. Once the dissolution application is submitted, there will be what’s known as a cooling-off period which lasts for 20 weeks. After this time has passed, the Conditional Order can be applied for, there will then be a further 6 weeks and one day until the applicant or joint applicants can apply for the Final Order.
Despite this minimum 6 month time period to receive the final order, other aspects which are involved in dissolving your civil partnership can take considerably longer. If you are unable to agree on how finances will be divided or where children will live, you may need to go to court for a decision.
WHAT ARE THE GROUNDS FOR CIVIL PARTNERSHIP DISSOLUTION?
There is only one ground for civil partnership dissolution, and that is that the civil partnership “has broken down irretrievably”. Applicants will need to provide a statement claiming this during the application process.
