Chancel Repair Liability
Most of us now know that Chancel Repair Liability has ceased to be an overriding interest on property recently.
It happened on 13 October 2013. For a liability to now bind future purchasers of property it must have been registered against the title to the property which it affects before that date. If property is acquired after 13 October 2013 and the liability has not been registered against the title then the new owner need not be concerned about liability. An examination of the registered title of the property at the Land Registry will reveal if there is an entry recording the existence of the liability. If the property is not registered at the Land Registry then a search in the Land Charges Registry will reveal any similar entry against the property.
